Article 1: Purpose and Scope of Service

Fleaz is a peer-to-peer (P2P) consumer-to-consumer (C2C) classifieds marketplace operating as an online noticeboard for the buying and selling of second-hand goods among international expatriates residing in South Korea.

• Intermediary Status: Fleaz acts solely as a passive intermediary connecting buyers and sellers. Fleaz is not an auctioneer, e-commerce store, broker, or commercial merchant.
• Compliance with E-Commerce Law: In compliance with Article 20 of the Act on Consumer Protection in Electronic Commerce, Fleaz is not a party to any transaction initiated on the Platform. The Platform serves exclusively as an information distribution system between independent users.
• No Platform Transactions: Fleaz does not process financial transactions, payments, escrow services, shipping, or deliveries. All transactions must be completed directly between users via face-to-face, hand-to-hand exchange.
• Third-Party Services: The Platform relies on third-party infrastructure providers, including Supabase Inc. for database and authentication services, and Google and Facebook for OAuth login. Fleaz is not responsible for the availability, conduct, or policies of these third-party services.

Article 2: Eligibility and Account Registration

• Legal Age: Fleaz is reserved for individuals aged 18 or older. You must be at least 18 years old, or the legal age of majority in your country of residence or nationality if that age is higher than 18, to create an account and use the Platform. By creating an account, you confirm that you meet this age requirement.
• Minors: Fleaz does not knowingly collect data from individuals under 18 years of age. If we discover, or have reasonable grounds to believe, that an account belongs to a person under 18, that account will be suspended and deleted.
• Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including OAuth logins via Google or Facebook, and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate, current, and complete information at registration and to keep it updated at all times.
• Identity Verification (Verified Fleazer Badge): Users may voluntarily request the "Verified Fleazer" badge by submitting a single photo showing themselves holding their government-issued ID. In compliance with the Personal Information Protection Act (PIPA), all unique identification numbers must be fully redacted before upload. Fleaz reviews this photo solely to verify name and portrait match. The submitted photo is automatically and permanently deleted a few days after review is completed, or sooner if never reviewed (see our Privacy Policy for exact retention periods). Fleaz does not guarantee the real-world behavior, safety, background, or legality of any verified or unverified user.

Article 3: User Content and Intellectual Property

• Your Content: By posting listings, photos, or messages on the Platform, you retain full ownership of that content. You grant Fleaz a non-exclusive, worldwide, royalty-free license to store, display, and distribute that content solely for the purpose of operating the Platform. This license ends when you delete the content or close your account.
• Fleaz Content: All Platform design, source code, branding, logos, and non-user-generated content are the exclusive intellectual property of Fleaz. You may not reproduce, copy, redistribute, or exploit any Fleaz-owned content without prior written permission.
• Respect for Third-Party IP: You must not post listings containing counterfeit goods, pirated content, or items that infringe on third-party intellectual property rights.

Article 4: User Conduct and Prohibited Items

You retain sole legal, civil, and criminal liability for all content posted and all messages sent through the Platform. You agree not to post listings or engage in conduct that violates the laws of the Republic of Korea.

Prohibited Items

The following are strictly prohibited from being listed on the Platform:

• Prescription or over-the-counter medications
• Opened, used, or unsealed cosmetics and skincare products
• Food items, beverages, homemade meals, or dietary supplements, in compliance with the South Korean Food Sanitation Act
• Alcohol, tobacco, or e-cigarettes
• Weapons, ammunition, or hazardous materials
• Counterfeit goods or items infringing on third-party intellectual property rights
• Any listings or services facilitating visa selling, visa tampering, or illegal employment arrangements

Prohibited Conduct

The following behaviors are strictly prohibited:

• Transmitting external URLs or hyperlinks within the Platform's messaging system, particularly those mimicking payment, banking, or courier applications
• Moving conversations off-platform prematurely to circumvent Platform safety features
• Repeated failure to attend agreed meetups without prior notification ("no-shows"), which constitutes a breach of these Terms and may result in account review

Article 5: Limitation of Liability and Disclaimers

The Platform is provided on an "as-is" and "as-available" basis. To the maximum extent permitted under applicable law in South Korea:

• Service Availability: Fleaz does not guarantee uninterrupted or error-free access to the Platform. Scheduled maintenance, technical failures, or third-party service disruptions may temporarily limit availability. Fleaz shall not be held liable for any loss or inconvenience arising from such interruptions.
• No Warranty on Listings: Fleaz does not inspect, verify, test, or validate the quality, safety, authenticity, legality, condition, or accuracy of any item or listing posted on the Platform.
• Social Features: The "Up for a Coffee" feature is entirely voluntary and user-controlled. Fleaz does not monitor, vet, or take any responsibility for real-world interactions, social behaviors, or personal safety outcomes arising from meetups arranged via this feature.
• Item Bundles (Lots): The creation, modification, and cancellation of multi-item bundles ("Lots") within the messaging system is entirely the responsibility of the interacting users. Fleaz is not liable for pricing disagreements, cancellations, or partial fulfillment of bundles.
• Exclusion of Damages: Except in cases of intentional misconduct or gross negligence directly committed by Fleaz, Fleaz, its founders, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, financial losses, fraud, scams, or physical harm arising from user interactions, chat conversations, or face-to-face meetups.
• Dispute Release: In the event of a dispute between users, you release Fleaz from all related claims, demands, and damages. Disputes must be resolved directly between the parties or through the Korea Consumer Agency (KCA) at www.kca.go.kr or by calling 1372 (no area code required).

Article 6: Reporting and Account Termination

• Community Reporting: Users may report suspicious listings or inappropriate behavior directly through the Platform's built-in reporting interface. Fleaz reserves the right to review reported content and cooperate with South Korean law enforcement or regulatory authorities where illegal activity is suspected.
• Message Monitoring: To protect the community from scams, Fleaz automatically screens message content for suspicious patterns (e.g., requests to pay outside the Platform, shortened or suspicious links). You acknowledge that Fleaz administrators may access and review the content of a flagged message, or of a full conversation that is the subject of a user report, solely for safety and dispute-resolution purposes.
• Account Sanctions: Fleaz reserves the right, in its sole discretion, to remove listings, suspend features, or permanently terminate accounts of users who violate South Korean law, engage in fraudulent behavior, transmit phishing links, or systematically compromise community safety. Sanctions may be applied automatically or by administrative decision based on reported conduct.

Article 7: Privacy

Your use of the Platform is governed by our Privacy Policy, available at fleaz.app/privacy. By using the Platform, you acknowledge and agree to the terms of our Privacy Policy.

Article 8: Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Korea. Any legal action or proceeding arising under these Terms shall be brought exclusively before the courts of competent jurisdiction in Seoul, South Korea, including the Seoul Central District Court.

Article 9: Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed entirely if modification is not possible. The invalidity of one provision shall not affect the validity or enforceability of the remaining provisions.

Article 10: Amendments

We may update these Terms to reflect platform changes or regulatory adjustments.

• Minor changes (technical corrections, wording clarifications): announced at least 7 days before taking effect, via a notice on the Platform.
• Material changes (changes that affect your rights or obligations): announced at least 30 days before taking effect, via Platform notification and direct email where feasible.

Continued use of the Platform after the effective date of any update constitutes acceptance of the revised Terms. The "Last Updated" date at the top of this document reflects the most recent revision.
